2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 74 and 126(2) of the BNS and under Section 8 of the POCSO Act.

3. The case of the prosecution is that the petitioner is a teacher in a school where minor daughter of the informant is studying. The minor daughter of the informant informed him regarding the bad touch by this petitioner to her and to other girl students.

4. Learned counsel for the petitioner has submitted that in this case trial has started and in the trial, informant and

Their deposition have been brought on record by supplementary affidavit and from perusal of the deposition of victim and informant it is clear that they have straightway denied the occurrence. The petitioner is a man of clean antecedent and is in judicial custody since 30.03.2025.

5. Learned counsel for the Informant is also present and he has no objection on the above arguments.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Babura P.S. Case No. 03 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-VI-cum-Special Judge, POCSO, Bhojpur at Ara.
