JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 27.01.2016 on the accusation that under his leadership, more than 5000 people blocked the passage of government officials, who had gone there to demolish the Haata on the direction of this court in CWJC. No. 19568 of 2014 and when the petitioner and his supporters refused to vacate the place, the police used water cannon as a result whereof mob became furious and started pelting stones causing injury to several police personnel and the revolver of a police officer was also snatched. Moreover, revolver of the police officer was recovered after alleged occurrence.

No.11149 of 2016 (2) dt.10-03-2016 2/2 No doubt, there is allegation that the mob set several vehicles on fire but considering the facts and circumstances of the case as well as submission of the parties and also taking note of period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S.Case No. 50 of 2016.
