The petitioner apprehends his arrest in Dariyapur P.S. Case No.31 of 2019 registered under Sections 341, 323, 294, 354, 504, 506 and 34 of the Indian Penal Code. The informant alleged that while she came out from her house to ease out, the petitioner and five other accused persons caught her with bad intention and assaulted her. On alarm, many persons came and saved the informant. Learned counsel for the petitioner submits that coaccused, namely Saddam Alam has already been granted anticipatory bail by a coordinate bench of this court by order dated 24.04.2019 passed in Cr.Misc.No.26812 of 2019. It appears that the informant made allegation that the petitioner and others in the dead of night caught the informant

Patna High Court CR. MISC. No.31671 of 2019(2) dt.13-05-2019 2/2 and assaulted her only because they were always stalking her before the occurrence and the informant objected to the acts of the petitioner and others but similarly situated co-accused has already been granted anticipatory bail and the case of the petitioner stands on the same footing.

Having considered the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Saran at Chapra in connection with Dariyapur P.S. Case No.31 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
