JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-08-2019 This is an application for grant of anticipatory bail in connection with Bidupur P.S. Case No. 486 of 2018, disclosing offences under Sections 341, 307, 387, 120B of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case disclosed that petitioner along with other accused persons came in the morning and fired in air from the pistol and thereafter, fled away. Thereafter, police had reached there. In the meantime, he heard the sound of firing from his Dalan, then the informant rushed towards his dalan and saw that petitioners and other accused persons fleeing away and so that his driver was in injured condition, who was referred to Patna. It is also stated that they were demanding Rangdari, for

Patna High Court CR. MISC. No.34293 of 2019(4) dt.02-08-2019 2/2 which, earlier threatened him of dire consequences. Submission of the learned counsel for the petitioners is that one of the accused has also filed a case against the informant and others. Further submission is that co-accused has been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court, vide order dated 19.07.2019, passed in Criminal Misc. No. 18889 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate XIV, Vaishali at Hajipur, in connection with Bidupur P.S. Case No. 486 of 2018,, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
