====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 15-05-2019 Heard learned counsel for the petitioner and the State. This application has been filed for modification of the order dated 21.8.2018 passed in Cr. Misc. 38616 of 2018. Counsel for the petitioner submits that petitioner was granted anticipatory bail by this Court by aforesaid order in which he was directed to surrender in the Court below within a period of six weeks from the date of order, but he could not surrender in the court below within stipulated time because he was out of State to earn his livelihood. The prayer has been made to extend time by further four weeks to surrender in the Court below.
This modification application is allowed with direction to petitioner to surrender in the court below within
Patna High Court CR. MISC. No.31946 of 2019(2) dt.15-05-2019 2/2 four weeks from the date of receipt/production of a copy this order. In the event petitioner surrenders in the court below within aforesaid period, he will be released on same terms and conditions as mentioned in the order dated 21.8.2018 passed in Cr. Misc. 38616 of 2018.
Let this order be communicated to the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Pipra P.S. Case No. 238 of 2017.
