The petitioner seeks bail in a case registered for the offences punishable under sections 364/34 and 120(B) of the Indian Penal Code.

Father of the deceased Pankaj disclosed that his son had gone along with Jitendra Kumar but he did not return. The informant enquired from Jitendra Kumar on which Jitendra disclosed that his son would return.

It is submitted that Warisnagar P.S. Case No. 19 of 2015 was registered by the petitioner for the kidnapping of Pankaj Kumar with one Scorpio vehicle. The Police Inspectorcum- S.H.O. Mufassil P.S. Samastipur lodged Singhiya P.S. Case

Patna High Court Cr.Misc. No.19166 of 2015 (4) dt.03-09-2015 no. 38 of 2015 and disclosed that Raman Kumar Singh @ Munna Singh and others confessed their guilt and disclosed that they killed Pankaj Kumar by strangulating his neck and threw the dead body.

It is submitted that of course, Pankaj went along with Jitendra Kumar but the police did not collect any evidence to show that the petitioner was also involved in the killing of Pankaj. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Samastipur in connection with Mufassil P.S. Case No. 40 of 2015.
