JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 15-05-2015 Heard learned counsel for the petitioner as well as learned APP for the State.

During vehicle check-up, on account of having been informed regarding transportation of narcotic substance, the driver after stopping pickup van, unsuccessfully, tried to escape who was apprehended who disclosed his identity to be the petitioner. Furthermore, three more accused persons were apprehended from the vehicle who disclosed their identity as Nagina Rai, Sitaram Rai and Vijay Rai. On search, three bags were seized containing Ganja.

It has been submitted on behalf of the petitioner that being a public carrier, he gave lift to other accused and since Ganja was kept inside the bag, he was unable to locate the same and that happens to be the reason behind presence of Ganja in his

Patna High Court Cr.Misc. No.17774 of 2015 (2) dt.15-05-2015 vehicle. Furthermore, petitioner has got no criminal antecedent and is under custody since 10.07.2014.

Accordingly, petitioner, Dashrath Rai is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Special Judge/Sessions Judge, NDPS Act, Vaishali at Hajipur in connection with Garaul PS Case No. 187/2014.
