2. The petitioner seeks bail in connection with Samho P.S. Case No. 01/2025, registered for the offence under Sections 80(2), 238, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The accused/petitioner is named in the F.I.R. and is in custody since 11.03.2025.

4. As per FIR, the petitioner caused death of daughter of the informant alongwith other co-accused persons/family members due to non-fulfillment of demand of dowry, as raised for one motorcycle.

5. Learned counsel appearing on behalf of the petitioner submitted that petitioner is the father-in-law and an old person aged about 65 years, having no connection with daily and domestic

It is submitted that even the allegation of dowry is appearing very much general and omnibus against this petitioner just to implicate petitioner with present crime in question out of his relation as he is the father of the husband of the deceased. It is submitted that soon after lodging the FIR realizing the wrong committed by him, the informant filed a retracted version before the learned A.C.J.M.- IV, Begusarai that under wrong impression, the present FIR was lodged and stated that his daughter died out of ailments. While concluding argument, it is submitted that investigation of this case is already completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence and, moreover, petitioner is a man of clean antecedent.

6. Learned APP opposed the prayer of bail.

Considering the aforesaid factual submissions and by taking note of fact as the petitioner being father-in-law is facing general and omnibus allegation qua raising demand of dowry, where the entire occurrence appears prima facie doubtful in view of retracted version of the informant as discussed aforesaid, coupled with the fact that investigation of this case is already completed, where petitioner being man of clean antecedent, remains in custody since 11.03.2025, accordingly, petitioner

Patna High Court CR. MISC. No.34133 of 2025(3) dt.16-09-2025 3/3 above named, is directed to be released on bail in connection with Samho P.S. Case No. 01/2025, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
