Petitioner is not named in the first information report but it appears that his name surfaced in this case in confessional statement of co-accused. Moreover, looted motorcycle was not recovered from possession of the petitioner and except criminal antecedent, there is nothing against the petitioner. Petitioner is languishing in jail custody since 30.10.2015 but, even then, the concerned officer did not take pain to arrange the T.I.P.
