2. The petitioners apprehend their arrest in connection with Islampur P.S. Case No. 180 of 2019 instituted under Sections 406, 420, 467, and 120(B) of the Indian Penal Code.

3. As per the prosecution case, co-accused Asha Devi has taken loan amount of Rs. 12,00,000/- (Twelve Lakh Rupees only) from the informant. Petitioners and other co-accused persons have made conspiracy to each other for receiving the said amount.

4. Learned counsel for the petitioners submits that there is no specific allegation against the petitioners. After

Patna High Court CR. MISC. No.34683 of 2023(2) dt.21-07-2023 2/2 investigation, Investigating Officer of the case submitted charge-sheet only against co-accused persons and the allegation against the petitioners was not found true. However, the Court below has taken cognizance against these petitioners also. Learned counsel further submits that the petitioners have no criminal antecedent.

5. Learned A.P.P. opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount to each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S. Case No. 180 of 2019, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
