The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

The prosecution case, in short, is that seven unknown miscreants came at the shop of the informant. Out of seven, four miscreants entered the shop and three remained outside the shop. It is also alleged that they looted ornaments worth Rs. 1.5 crores.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 07-03-2019. The petitioner is not named in the FIR. There is no recovery of any incriminating article from possession of the petitioner. The

Patna High Court CR. MISC. No.31585 of 2019(2) dt.14-05-2019 2/2 petitioner was not put on test identification parade. It has further been submitted that the petitioner may be released after completion of six months in custody.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of six months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 99 of 2019.
