JUSTICE RAJESH KUMAR VERMA ORAL ORDER 19-06-2025 Heard Mr.Pankaj Kumar Sinha, learned counsel for the petitioner, Mr. Ashhar Mustafa, learned counsel for the Patna High Court and Mr.Raj Kishor Singh, learned Additional Public Prosecutor for the State.

2. The petitioner is apprehending his arrest in connection with Kotwali P.S. Case No.147 of 2023, dated 28.02.2023 registered for the offences punishable under Sections 419,420,467,468 and 471 of IPC.

3. The prosecution case, in short, is that the allegation has been levelled against the petitioner that he under conspiracy with other co-accused were involved in

No.35783 of 2025(2) dt.19-06-2025 2/3 making false and fake appointment on the post of Peon in the establishment of the Hon'ble High Court, Patna and this petitioner by playing fraud, obtained a fake identity card of Hon'ble High Court, Patna containing false signature of learned Registrar General of Hon'ble Court.

4. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case. As per allegation in the FIR, the petitioner has obtained the false and fake appointment on the post of Peon in the establishment of High Court, Patna and also bears a false identity card duly signed by the learned Registrar General, High Court, Patna. Learned counsel for the petitioner submits that in fact the petitioner has given Rs.10, 000/- (Ten Thousand) to one Subhash Chandra and he has given all the documents as mentioned in the aforesaid and the petitioner worked in the establishment of High Court, Patna.

5. Learned counsel for the High Court, Patna has vehemently opposed the prayer for anticipatory bail of the petitioner and submits that the petitioner is well aware that his appointment was not in accordance with law and despite of that, he has joined the post in question and apart from that,

6. Considering the aforesaid facts and nature of allegation against the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Kotwali P.S. Case No.147 of 2023 pending in the court of learned Chief Judicial Magistrate, Patna.
