The petitioner seeks bail in Karpi P.S. Case No. 41 of 2013, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, five unknown miscreants killed Sanjay Singh, brother of informant.
It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case and no motive has been attributed to him. The dead body was found in the Angan of Dukhit Ram, but the statement of Dukhit Ram was not recorded by the IO. Similarly situated co-accused has been granted bail by this Court vide order dated 10.03.2014
Patna High Court CR. MISC. No.43745 of 2021(3) dt.03-01-2022 2/2 passed in Cr. Misc. No. 1897 of 2014. Petitioner is in custody since 02.06.2021. Chargesheet has already been submitted. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Arwal, Jehanabad in connection with Karpi P.S.
