The petitioner is one of the ten accused persons named in the FIR vide Mahua P.S. Case No. 398 of 2013 registered under section 302 IPC wherein it is alleged that the accused persons came on to the field and started indiscriminately assaulting the father of the informant who was picking up the branches of the palm tree. He received injuries which subsequently proved fatal.
The contention of the petitioner is that he has falsely been implicated in this case on account of land disputes and nowhere it has been alleged that he was armed with a sharp-cutting weapon. The petitioner is in custody since 14.01.2015 having no criminal antecedent. Another co accused of this case namely Vijay Das has
Patna High Court Cr.Misc. No.18325 of 2015 (2) dt.29-06-2015 2/2 been released on bail vide order dated 14.07.2014 passed in Cr. Misc. No. 16507 of 2014 (Annexure-3).
Considering the above, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Vaishali at Hajipur in Mahua P.S. Case No. 398 of 2013 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge he shall appear in person on each date fixed at the trial. Failure in appearance on two consecutive dates shall lead to cancellation of his bail bonds.
