1. Heard learned counsel for the appellant and Mr. Binay Krishna learned Special Public Prosecutor for the State.
2. This is an appeal under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the "SC/ST Act") against the refusal of prayer for anticipatory bail vide order dated 16.01.2024 in A.B.P. No. 3877 of 2023 passed by the learned SC/ST Exclusive Special Judge, Saran at Chapra in connection with Taraiya P.S. Case No. 318 of 2023 registered under Sections 384, 385, 353, 500, 506 and 120(b) of the Indian Penal Code, Section 66(A)(a)(b) of the I.T. Act as well as
Patna High Court CR. APP (SJ) No.2282 of 2024(2) dt.10-05-2024 2/2 Sections 3(i)(r) and 3(2)(va) of the SC/ST Act.
3. This is the second attempt of the appellant to seek anticipatory bail by filing the present appeal.
4. Mr. Binay Krishna learned Special Public Prosecutor, at the outset, submits that appellant had moved earlier seeking anticipatory bail by filing Cr. Appeal (SJ) No. 976 of 2024 and the same was rejected on the ground that the appellant has not approached the Court with clean hands as he had concealed his antecedent.
5. Considering the submissions made by the learned Spl.P.P., the Court is not inclined to entertain the prayer for anticipatory bail. Hence, this appeal stands rejected. (Satyavrat Verma, J) Kundan/- U T
