ANJANA MISHRA ORAL ORDER 20-07-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is in custody since 30.3.2014 in connection with N.D.P.S. Case No.33 of 2014 arising out of Railway Raxaul P.S. Case No.04 of 2014 registered for the offences under Sections 20(b),(ii)(c),21(c),22,23,24 of the N.D.P.S. Act.

The allegation against the petitioner is that while she along with two other persons was going towards Raxaul Railway Station, they were apprehended and from their possession 10 Kg. 800 Grams Charas like substance are reported to have been confiscated.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.18171 of 2015 (3) dt.20-07-2015 2/2 seizure list was prepared in contravention of law inasmuch as it does not bear the signature or thumb impression of the petitioner, though in the F.I.R. it has been stated that thumb impressions were taken from them.

Having perused the seizure list and considering the period of custody and also the fact that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on her furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, East Champaran at Motihari, in connection with N.D.P.S. Case No.33 of 2014 arising out of Railway Raxaul P.S. Case No.04 of 2014. (Anjana Mishra, J) PNM U T
