The petitioner being the husband of the informant is languishing in custody since 23.01.2016 in a case registered for the offences punishable under sections 323, 498A, 504, 506, 406, 494, 34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

Accusation is of torture for non-fulfillment of dowry demand and performing second marriage.

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant and denies to have performed second marriage. A statement to that effect has been made in paragraph 12 of the petition which reads as follows :-

Patna High Court Cr.Misc. No.10803 of 2016 (4) dt.20-04-2016 2/2 "That, it is wrong to say that the petitioner solemnized another marriage with Pinky Kumari." Learned APP for the State after going through the case diary submits that the investigation has already concluded and final form has been submitted.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Munger, in connection with Kasim Bazar P.S. Case No.181/2015.
