2. The petitioners seeks bail in connection with Muffasil P.S. Case No. 50 of 2026 instituted for the offences under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 103(1) & 3(5) of the Bharatiya Nyaya Sanhita.
3. The allegation is that the informant's father namely, Sukhari Sahani was surrounded and assaulted by 14 persons. The specific allegation of assaulting on the informant's father is on Ram Ekbal Sahani and Raj Kumar Sahani. The petitioner
Patna High Court CR. MISC. No.34216 of 2026(2) dt.20-05-2026 2/3 no.1 is said to have assaulted Saheb Kumar on head who got injured.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Counsel submits that the petitioners are in custody since 27.01.2026, having no criminal antecedent.
5. Learned A.P.P for the State has vehemently opposed the prayer for grant of bail to the petitioners.
6. Considering that the petitioners are not the assailants of the deceased and the allegation is against 14 persons and the petitioners have no criminal antecedent and they are in custody since 27.01.2026, this Court is inclined to grant bail to the petitioners.
7. Let the petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran, in connection with Muffasil P.S. Case No. 50 of 2026.
8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case
