1. Heard the parties.
2. The petitioners apprehend their arrest in connection with Bheldi PS Case No. 61 of 2010 dated 30.06.2010 registered under Section 147 / 148 / 342 / 323 / 353 / 420 / 504 of the IPC.
3. As per the FIR based upon the written report submitted by the informant, who is Revenue Karmchari of AnchalAmnour, 28 named accused persons made the informant hostage for 04 Hours on 26-06-2010 while the informant had visited the spot for the purpose of preventing the accused persons from constructing Hanuman Mandir on the shairat land. The BDO and C.O., Amnour and Executive Magistrate arrived on the spot
Patna High Court CR. MISC. No.39012 of 2023(2) dt.28-07-2023 2/3 and rescued the informant after some time.
4. Learned counsel for the petitioners submits that petitioners have not committed any offence in the manner alleged and the allegation against them is general and omnibus in nature along with 28 named accused persons. He further submits that occurrence had taken place on 27-06-2010 but FIR has been lodged after three days on 30.06.2010 and the petitioners were not having knowledge of their involvement in the FIR. After coming to know about the FIR lodged, steps for anticipatory bail have been taken. He further submits that the co-accused / Akhileshwar Prasad Singh has been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc No. 30771 of 2023.
5. Regard being had to the submission made by the parties, taking into consideration the nature of allegation which is general and omnibus in nature and the fact that co-accused has been granted anticipatory bail, as such, I am inclined to grant anticipatory bail to the petitioners.
6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees ten thousand) each with two
