JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bakhtiyarpur P.S. Case No. 284 of 2015 registered under Sections 279, 337, 338 and 427 of the Indian Penal Code and Section 25(1B)A, 26 and 35 of the Arms Act. The accusation is that petitioner is said to be apprehended by the police having one country made pistol along with five live cartridges.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to ulterior motive. It is further submitted that petitioner has no criminal antecedent and he is in custody since 22.09.2015.

Patna High Court Cr.Misc. No.13637 of 2016 (2) dt.12-04-2016 Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Barh, Patna, in connection with Bakhtiyarpur P.S. Case No. 284 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
