The petitioner seeks bail in anticipation of his arrest in connection with Barsoi P. S. Case No. 254 of 2019, dated 13.10.2019, instituted for the offences under Sections 295 and 295(A) of the Indian Penal Code. He has not been named in the F.I.R. and his implication in this case is on the basis of statement of two of the witnesses, who had over-heard the petitioner talking to somebody about the occurrence. Such statement has also come after one and half months of the registration of the case.

One of the similarly situated persons has been granted bail by this Court vide order dated 19.02.2021, passed in Cr. Misc. No. 32606 of 2020.

Regard being had to the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Katihar, in connection with Barsoi P. S. Case No. 254 of 2019, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The application stands allowed.
