JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code and 22/20 of the NDPS Act.

Admittedly, neither petitioner was caught on the spot nor anything was recovered from his conscious possession. The name of this petitioner came in this case on the basis of statement made by co-accused,Ajay Singh who was caught on the spot. Petitioner does have criminal antecedent of six cases but a co-ordinate Bench of this Court vide order dated 13.02.2019 passed in Cr. Misc. No. 78775 of 2018 directed the trial court to release the co-accused Ajay Singh after framing of

Patna High Court CR. MISC. No.33405 of 2019(2) dt.21-05-2019 2/2 the charge.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge cum Special Judge, Muzaffarpur in connection with Muzaffarpur Rail P.S.No. 102 of 2017.
