JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

The informant claims in his Fardbeyan that 5-6 unknown persons committed murder of his son but in course of investigation when after 2-3 days of the alleged occurrence further statement of the informant was recorded, the informant claimed that he had seen the petitioner fleeing from the place of occurrence in the light of electric.

Learned counsel points out that the alleged occurrence took place on 17.09.2012 and after two months of the

No.16358 of 2016 (2) dt.22-04-2016 aforesaid occurrence, the informant filed protest petition on 08.11.2012 but in the said protest petition the informant did not disclose the name of the petitioner and, therefore, further statement of the informant recorded by the I.O. appears to be doubtful. It is further submitted that several co-accused persons have already been granted the privilege of bail by different Benches of this Court.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties and also taking note of the fact that the petitioner is in jail custody since 23.01.2016 and investigation against him has already been completed, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City in connection with Sultanganj P.S.
