2. The petitioner seeks bail in connection with Desari P.S. Case No. 227/2021 registered for the offence punishable under Sections 304(B)/201/34 of the Indian Penal Code.

3. This is the second attempt of the petitioner for grant of bail. Earlier his application was rejected vide order dated 16.10.2023 passed in Cr. Misc. No. 67042 of 2023.

4. It has been submitted by the learned counsel for the informant that the case has not been committed. He further submits that deceased was being treated for ailment from before in Hisar and thereafter she fell ill and while being taken to a higher centre, she passed away on the way.

5. Learned counsel appearing on behalf of the informant has vehemently opposed the prayer for bail and submitted that prescriptions with the medical documents showed that the victim had been treated for some ailment earlier but not in the recent past.

6. The petitioner is in jail since 25.05.2023 and he claims to have clean antecedent.

7. I have considered the submissions of the parties.

8. Considering the fact that the petitioner is in jail since 25.05.2023 and there is no progress in the trial this application is allowed. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IXth/concerned court in connection with Desari P.S. Case No. 227/2021. (Sandeep Kumar, J) Saif/- U T
