The petitioner seeks bail in a case registered under Sections 8, 20, 22, 25, of NDPS Act.

The allegation against the petitioner is that in course of search, one Jio Mobile with Sim No. 6207153513 was recovered. Allegedly, 6 kgs. Ganja was recovered from the house of one, Bijay Tanti.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 22-03-2019. Charge sheet has already been submitted. 6 Kg. Ganja is alleged to have been recovered from house of co-accused Bijay Tanti. Same is below

Patna High Court CR. MISC. No.31581 of 2019(2) dt.14-05-2019 2/2 the commercial quantity. Hence there is no application of Section 37 of the NDPS Act. There is no compliance of Sections 42 & 50 of NDPS Act.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Begusarai in connection with Sahebpur Kamal P.S. Case No. 75 of 2019 corresponding to N.D.P.S. Case No. 07 of 2019, CIS No. 11 of 2019.
