The petitioner seeks bail in a case instituted under Sections 376, 426, 427 and 201/34 of the Indian Penal Code. The allegation against the petitioner is of committing rape upon the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.02.2016. Charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. From perusal of para-34 and 35 of the case diary, it appears that the petitioner has falsely been implicated in the present case. From perusal of the medical

Patna High Court Cr.Misc. No.24013 of 2016 (6) dt.21-09-2016 2/2 examination report of the victim, it is evident that the allegation made in the First Information Report is not supported. On behalf of the state it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Biharsharif at Nalanda, in connection with Biharsharif at Nalanda Mahila P.S.
