2. The petitioner seeks regular bail in connection with Sheikhpura Mahila P.S. Case No.61 of 2023, lodged on 27.12.2023, under Section 354B of the Indian Penal Code and under Section 8 of the POCSO Act.

3. As per the prosecution, FIR has been lodged against the present petitioner alleging that he has tried to outrage the modesty of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the petitioner is in custody since 11.03.2024 having no criminal antecedent. Counsel submits that as per the FIR, the date of occurrence is 20.12.2023 whereas the present case has

Patna High Court CR. MISC. No.38372 of 2024(2) dt.27-05-2024 2/2 been lodged on 27.12.2023. Counsel for the petitioner submits that the petitioner has been made victim in this case. He went to his Sasural where he was assaulted by the informant side for which the petitioner side had lodged criminal case which is Annexure-3 of the present bail petition. Counsel submits that as soon as the informant side received information that petitioner side is going to file criminal case, thereafter they had filed the present case against him.

5. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner, above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VI, Sheikhpura in connection with Sheikhpura Mahila P.S. Case No.61 of 2023, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
