The petitioner is in custody since 11.10.2014 in connection with Manjhagarh P.S. Case No. 242 of 2014 registered for the offences punishable under Section 25(1-b) A/26 of the Arms Act.
That the prosecution case lodged by the informant and it is alleged that on 10.10.2014 at 8.30 p.m., he received secret information that one accused person on NH-28, near Jhajhawa village was moving here and there. After police party reached at Village Jhajhawa it found one person fleeing away having seen the police and he was caught and from his pocket one loaded country made pistol and a Nokia Mobile were recovered from his
Patna High Court Cr.Misc. No.18249 of 2015 (3) dt.12-08-2015 2/2 possession regarding which no document was produced by him. In pursuance of this Courts order, a supplementary affidavit has been filed, stating therein that the petitioner is on bail in all cases as mentioned in Para-3 of the said application. It has been submitted by the petitioner that the allegations against him are false and nothing has been recovered from his possession. It has further been submitted that the petitioner is a serious patient of Hapatites B and was under active treatment at AIIMS, New Delhi between 22.10.2013 to 18.09.2014.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Manjhagarh P.S. Case No. 242 of 2014.
