JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 18.03.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner seeks bail in a case registered under sections 399, 402 of the Indian Penal Code as well as sections 25 (I-b) a, 26, 35 of the Arms Act.

One country made loaded pistol and one live cartridge were recovered from conscious possession of the petitioner when he along with others were caught by the police.

No doubt, petitioner carries criminal antecedent of two cases but co-accused Umesh Goswami and Md Salim @ Shamim, having more or less similar allegation, have already been granted privilege of bail by this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya
