Learned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application with respect to petitioner nos. 1 and 2 i.e. Baijnath Das and Babloo Das.

Permission is accorded.

Accordingly, the present anticipatory bail application is dismissed as withdrawn with respect to petitioner nos. 1 and 2.

The petitioner no. 3 apprehend his arrest in a case

Patna High Court CR. MISC. No.34955 of 2022(2) dt.28-11-2022 2/2 registered for the offences punishable under Sections 447, 341, 323, 324, 307, 379, 354A, 504 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that so far as petitioner no. 3, Dinesh Das, is alleged, he has antecedent of two cases but then there is no specific allegation alleged against him with regard to assault.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Shankarpur P.S. Case No. 50 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Rishabh/- U T
