2. The petitioners seek bail in a case registered for the offence punishable under Sections 309(4) of the B.N.S.
3. The First Information Report discloses that three unknown persons looted an amount of Rs. 1,22,484/- from the informant along with a mobile and some other articles which was kept in the bag along with the collected money.
4. Learned counsel for the petitioners submits that the First Information Report was lodged against unknown three miscreants and the name of the petitioners have transpired during the course of investigation as they have all been

Case No. 204 of 2024 wherein it is said that they have confessed their involvement in the present case. It has also been mentioned that the weapon used in the said incident and cash was handed over to Sonu Kumar, who is petitioner no. 1, who has hidden the same in his shop and the remaining articles and the mobile was kept by the accused Vishal Kumar himself. It has also been stated that the police recovered the weapon and cash from the shop of Sonu Kumar in connection with Ganga Bridge P.S. Case No. 204 of 2024. Further, the police has also recovered Vivo Mobile from the petitioner no. 3 Vishal Kumar. It has further been submitted on behalf of the petitioners that till date no Test Identification Parade has been conducted in the case to establish the complicity of the petitioners and the petitioners are in custody since 30.11.2024 and the charge-sheet has been submitted.
5. Learned APP for the State has opposed the application for bail.
6. Taking into consideration the fact that the recovery of weapon and cash has been made from the shop of Sonu Kumar on the basis of confession recorded, I am not inclined to grant bail to Sonu Kumar, petitioner no. 1 at this stage.

7. However, petitioner no. 1 would be at liberty to renew his prayer for bail after framing of charge.
8. So far as other two petitioners, namely, Chandan Kumar and Vishal Kumar are concerned, let the above named petitioners, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Ganga Bridge P.S. Case No. 171 of 2024, subject to the condition that the petitioners would appear before the learned Court below on each and every date till the charges are framed. (Soni Shrivastava, J) devendra/- U T
