The plea of the petitioner is that he appeared at the examination after five years and the result of the petitioner was withheld.

Since the University allowed the petitioner to appear at the examination after five years with open eyes and as such withholding of result is not justified in view of the judgment of the Apex Court in the case of Shri Krishnan vs The Kurukshetra University, reported in AIR 1976 SC 376.

Patna High Court CWJC No.18258 of 2018(4) dt.16-08-2019 2/2 Considering the judgment of the Apex Court, the writ application is allowed. The University is directed to publish the result of the petitioner (B.A. Hons) at the earliest within a period of 45 days from the date of receipt/production of a copy of this order.
