02-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Rajpur P.S. Case No. 242 of 2019, registered for the offence under Section 392 of the Indian Penal Code.

As per the prosecution case, while the informant was going to Dewarhia from his village, two unknown miscreants intercepted him and on the point of pistol, snatched the motorcycle and mobile phone of informant.

Petitioner is not named in the FIR. Name of the petitioner has transpired during course of investigation. No incriminating article has been recovered from the possession of the petitioner and till date, petitioner has not been put on T.I.Parade. Petitioner is in custody since 02.12.2019. Chargesheet has already been submitted.

Patna High Court CR. MISC. No.44049 of 2021(3) dt.02-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Buxar / concerned court in connection with Rajpur P.S.
