JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-03-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

There appears to be recovery of stolen motor cycle from the house of the petitioner and taking into account the aforesaid fact learned Sessions Judge rejected the prayer for bail of the petitioner giving liberty to him to renew his prayer for bail after six months if no substantial progress is made in his trial.

In my view, learned Sessions Judge has passed appropriate order and, accordingly, this petition filed in connection with Sitamarhi P.S. case No. 961 of 2015 stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of prayer for bail of the petitioner in the light of order dated 11.02.2016 passed by learned Sessions Judge, Sitamarhi.
