Petitioner seeks regular bail in a case registered for the offence punishable under Section 354(A) and some other allied Sections of the Indian Penal Code and u/s 8 of POCSO Act.

As per the prosecution case, this petitioner is alleged to have tried to outrage the modesty of the minor daughter of informant.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case due to village politics and delayed FIR has been lodged. As per FIR the occurrence took place on 02.05.2020 but the FIR

Patna High Court CR. MISC. No.44947 of 2021(3) dt.04-01-2022 2/2 was lodged on 05.05.2020 after three days of the occurrence without any explanation. Petitioner claims clean antecedent and is in custody since 25.02.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI-cum- Special Judge, POCSO Act, Bhagalpur in connection with Kajraili PS case No. 30/2020.
