Public Prosecutor for the State.

Petitioner seeks bail in a case registered under section 414 of the Indian Penal Code as well as sections 25 (I-b) a, 26,35 of the Arms Act.

One motorcycle is said to have been recovered from conscious possession of the petitioner.

Admittedly, the aforesaid motorcycle has already been released in favour of one Hari Narain Mahto who happens to be covillager of the petitioner and has no complain against the petitioner. So far as firearm is concerned, no firearm has been recovered from conscious possession of the petitioner who is languishing in jail custody since 23.11.2015. Accordingly, petitioner is directed to be released on bail on
