Petitioner is not named in the first information report but in course of investigation, one witness Shambhu Paswan and some others claimed that prior to the alleged occurrence, the deceased was, mercilessly, beaten up by the petitioner but the aforesaid witness, Shambhu Paswan has admitted in his statement that he came on the place of occurrence having got the news of recovery of a dead body and, therefore, the aforesaid statement demonstrates that the aforesaid witness had already reached near the place of occurrence before the registration of the present case but he did not disclose the
