JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-01-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under sections of the Indian Penal Code. As per the prosecution case, petitioner is alleged to have committed sexual assault on the 12/13 years old informant's daughter.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case as the doctor has not found any sign of sexual assault on the body of the victim. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 6/11/2019.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.44421 of 2021(3) dt.03-01-2022 2/2 bail and submits that the victim 12/13 years old and the victim has supported the allegation of sexual assault against the petitioner. Even the doctor has also supported the prosecution case.

Considering the nature of accusation against the petitioner, his prayer for bail is refused.
