The petitioner seeks bail in a case under Section 438 and other Sections of the Indian Penal Code. The petitioner is not named in the FIR. The petitioner was arrested on the basis of information of the spy of the police. Except the confessional statement of the petitioner, the Investigating Officer did not collect any tangible evidence. It is submitted that similarly situated co-accused persons have already been enlarged on bail.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Jehanabad
