The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that during investigation one apprehended accused Shambhu Sah was disclosed the name of the petitioner and has got one Criminal antecedent i.e. Saraipati P.S. Case No. 176 of 2018. The similarly situated co-accused has been granted Anticipatory bail by the Coordinate Bench of this Hon'ble Court in Cr. Misc. No.74327 of 2018.

In the aforesaid facts and circumstances of the case,

Patna High Court CR. MISC. No.33859 of 2019(2) dt.23-08-2019 2/2 let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIX, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S. Case No. 236 of 2018 (G.R. No. 1635 of 2018), subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
