2. The petitioner is apprehending her arrest in Obra P.S. Case No. 425 of 2022 registered under Section 420 of the Indian Penal Code.
3. Allegedly, Rs. 14,14070/- was credited in the account of the ward meant for tap water work (Nal Jal Yojana) but the work was not completed.
4. It has been submitted on behalf of the petitioner that under the Nal Jal Yojana, the petitioner has completed the work of Rs. 11,67,271/- and he is ready to deposit the rest amount of Rs. 46,799/-
5. The counter affidavit filed by the District Magistrate,
Patna High Court CR. MISC. No.34792 of 2025(4) dt.17-11-2025 2/2 Aurangabad shows that the work has been completed up to the value of Rs. 11,67,271/- as per the measurement book and the balance amount is Rs. 46,799/-
6. The petitioner is directed to deposit Rs. 46,799/- in the government treasury.
7. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Obra P.S. Case No. 425 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of BNSS, 2023.
8. The receipt of challan showing deposit of Rs. 46,799/- should be filed at the time of furnishing bail bonds. (Nawneet Kumar Pandey, J) A.K.V.//- U T
