The petitioner is apprehending his arrest in connection with Dagarua P.S.Case no.15 of 2018 , registered for offences punishable under Sections 147, 148, 149, 323, 324, 307, 379, 504 of the Indian Penal Code.

Prosecution story is that the petitioner happens to be order-giver and the allegation of assault is against the other accused persons.

Submission of the learned counsel for the petitioner is that accused persons against whom there is allegation of assault have been granted privilege of anticipatory bail by this Court, vide order dated 27.7.2019 passed in Cr. Misc. No.43598 of 2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea in connection with Dagarua P.S.Case No.15 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
