Patna High Court CWJC No.13769 of 2021(4) dt.04-12-2025 2/3 petitioners under Article 226 of the Constitution of India seeking the following reliefs :- "1. That this writ application is being filed for issuance of appropriate writ/writs, order/ orders for setting aside the order dated 07.06.2019 passed by the learned Collector-cum-District Magistrate, Patna in L.C. Appeal Case No. 25/201112, whereby and whereunder the appeal filed by these petitioners against the order dated 30.11.2011 passed in Land Ceiling Case No. 08 of 2010 by the learned Deputy Collector Land Reforms, Barh, Patna, has been dismissed and further direction has been given to the Deputy Collector Land Reforms, Barh, to return the entire deposit amount in the proceeding of Land Ceiling Case No. 08/2010-11 to the depositor (petitioners) in one installment and/or for other relief or reliefs to which the petitioners may be found entitled to in course of hearing of this writ application."

2. Mr. Manish Kumar No. 2, learned counsel for the petitioners and Mr. Sajid Salim Khan, learned SC-25 for the State-respondents, are present and they are heard.

During the course of argument, learned counsel appearing for the petitioners submits that at present, the petitioners' grievance is only to get the purchase amount already deposited by them with a sum equal to 10% thereof, in the light of the direction given by the District Magistrate-cum-Collector, Patna (Annexure-3), and also in the light of the provisions of

Patna High Court CWJC No.13769 of 2021(4) dt.04-12-2025 3/3 section 16(4) of the Bihar Land Reforms (Fixation of Ceiling Area and Acquisition of Surplus Land) Act, 1961 (in short, 'Bihar Land Ceiling Act'). It is further submitted that the petitioners will have a right to challenge the impugned order in future if any further amendment is made to the Bihar Land Ceiling Act.

Considering the aforesaid submission, the instant writ petition stands disposed of, with giving a direction to the District Magistrate-cum-Collector, Patna (respondent No. 2), to ensure compliance of his own order dated 07.06.2019 (Annexure-3) within four weeks from the date of receipt of a copy of this Court's order or production of the same.
