The petitioner seeks bail in a case registered under Sections 25(1-B)a, 26(i) (ii), 35 of the Arms Act and Sections 30(a)/ 32(b)/ 38(a) of the Bihar Prohibiton & Excise Amendment Act 2018.

It is submitted that the petitioner has falsely been implicated in this case merely because he was present at the paltry farm. Counsel for the petitioner submits that no recovery whatsoever has been made from the petitioner's possession. He is in custody since 6.11.2018 and has no criminal antecedent. Shankar Vishwakarma who was also arrested in course of raid has been enlarged on bail in Cr. Misc. No. 25085

Considering the aforesaid submissions and in the facts and circumstances of the case, petitioner's prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 2nd, Lakhisarai in Lakhisarai PS Case No. 712 of 2018 on the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to the cancelled.
