Let the defect(s), if any, as pointed out by the office be removed within four weeks.
The petitioner is an accused in connection with Runnisaidpur P.S. Case No. 28 of 2021 under Section 392 of the Indian Penal Code.
As per the prosecution story, the informant, who works in Micro Finance Company, after collecting money reached Manpur Jeva Centre, three accused persons confronted him and on the point of pistol snatched Rs. 18,800/- as also another Rs. 200/-, Nokia Mobile, motorcycle etc. which

Learned counsel for the petitioner submits that because he has criminal antecedent, he has been implicated in this case for which he has already suffered by being in jail since 10.08.2021.
Considering the fact that he is in custody since 10.08.2021, charge sheet stands submitted and ultimately he has to face the trial, this Court is inclined to grant him privilege of bail after framing of the charges.
Let the petitioner be released on bail after framing of charges on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each to the satisfaction of learned Magistrate 1st Class, Sitamarhi in connection with Runnisaidpur P.S. Case No. 28 of 2021, subject to the following conditions.
(i) one of the bailor should be the family member of the petitioner, who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of bail by the Trial Court itself;

No.34873 of 2022(2) dt.16-09-2022 3/3 (iii) he shall appear before the concerned police station every fortnight for next six months to mark his presence; (iv) he shall in no way try to induce or promise or threat the witnesses or tamper with the evidence, failing which the State shall be at liberty to take steps for cancellation of his bail bonds;
(v) the petitioner shall desist from committing any criminal offence again failing which the State shall be at liberty to take steps for cancellation of his bail bonds. With the aforesaid observations, the bail application is allowed.
The Superintendent of Police, Sitamarhi should take note of the criminal antecedents the petitioner is having and take necessary corrective measures.
Let a copy of the order be sent to the office of the Superintendent of Police, Sitamarhi.
