2. The petitioner is in custody in connection with Ujiyarpur P.S Case No. 18 of 2023 registered for the offences punishable under Sections 379 of I.P.C. and after investigation, police submitted charge sheet under Section 392, 411 of I.P.C.

3. As per prosecution case, it is alleged that petitioner has stolen the bike of the informant.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that during investigation no TIP has been conducted during investigation. It is further submitted that nothing has been recovered from the conscious possession of the petitioner.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR, impugned order and stage of trial, it appears that nothing has been recovered from the conscious possession of the petitioner and no TIP conducted during investigation and also it appears from the stage of trail report that there is no progress with regard to the proceedings of the trial in the present case.

7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Dalsingsarai, Samastipur in connection with Ujiyarpur P.S Case No. 18 of 2023, subject to the condition that petitioner shall remain physically present on each and every dated fixed by the trail Court till conclusion of the trail.
