JUSTICE SUDHIR SINGH ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 458, 384, 386 and 506/34 of the Indian Penal Code. The prosecution case, in brief, is that one Rajiv Ranjan Singh gave his written statement before S.H.O.,Sasaram Muffasil P.S. stating therein that he look after the Hotlix Plant of M/s Birendra Prasad Singh. It is further alleged by the informant that on 24.12.2014 in the night some unknown miscreants came and threatened to his staff and asked his owner to talk with him. Thereafter the Hotmix Plant runs, who disclosed his name as Rohit Jee and also gave his mobile number and further asked the mobile number of the owner and on refusal they assaulted with danda. It is further alleged that the petitioner and one another

Patna High Court Cr.Misc. No.25455 of 2016 (4) dt.16-08-2016 2/2 Raju Singh in the month of May came to his stock and made demand of Rangdari. It is suspected that the petitioner and another have committed the alleged occurrence for Rangdari. It is submitted on behalf of the petitioner that the petitioner is in custody since 26.05.2015. Charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. The petitioner has been named on the basis of suspicion. There is no direct or indirect evidence against the petitioner. He has been remained in custody for more than one year.

On behalf of the State, it is submitted that the petitioner is named in FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ranjeet Kumar, learned Judicial Magistrate, 1st Class-cum- Add. M.- 7,Rohtas at Sasaram in Sasaram (M) P.S.Case No. 1303 of 2014. (Sudhir Singh, J) singh/- U T
