Petitioner is in jail custody since 1.7.2014 in a case registered under section 307 and other minor sections of the Indian Penal Code.
At para 7 of the case diary, statement of informant has been recorded and he stated before the Investigating officer that this petitioner gave dagger blow to him as a result of which he sustained injuries on his abdomen. Para 53 of the case diary shows that when injured was examined, three incised wounds were found on his person but the doctor could not ascertain depth of the aforesaid injury and the aforesaid doctor did not give his opinion regarding nature of the aforesaid injuries. The Investigating officer could not collect initial report of the injured and there is nothing on the entire case diary to show nature of the injuries sustained by injured.
Patna High Court Cr.Misc. No.3004 of 2015 (3) dt.17-04-2015 Considering the aforesaid facts and circumstances as well as the period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Masaurhi District Patna in Bhagwanganj P.S. Case no. 06/2014.
