The instant application for grant of regular bail has been filed by the petitioner in connection with Raushanganj P.S. Case No. 13 of 2017 for the offence punishable under Section 414 of the Indian Penal Code, Section 25 (1-B)a, 26 and 35 of the Arms Act and Section 17 of the C.L.A. Act. Earlier regular bail petition of the petitioner was twice rejected vide order dated 6.1.2020 passed in Cr. Misc. No. 80133 of 2019 and vide order dated 18.08.2021 passed in Cr. Misc. No. 27427 of 2021.

In pursuance to the direction of this Court, a report with regard to the present stage of the case has been received,

Patna High Court CR. MISC. No.34670 of 2022(8) dt.05-04-2023 2/2 which has been kept at flag 'X'.The report of learned J.M. 1st Class, Sherghati, Gaya suggests that charge has been framed in the matter and the case is running for prosecution evidence. It is not mentioned in the report that how many witnesses are to be examined. It seems that court below is taking lackadaisical view in this matter.

No new ground is made out for reconsideration of bail application of the petitioner. Accordingly, this application is rejected.

The learned trial court is directed to conclude the trial within a period of six months without fail.
