JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 and 120B of the Indian Penal Code.

Petitioner is named in the first information report but admittedly, none had seen the actual killing of the deceased and the dead body of the deceased was found on a road. Furthermore, the first information report reflects that deceased had sweet relation with petitioner and he used to visit her house which caused annoyance to first husband of the petitioner and in course of investigation, some witnesses claimed to have seen that prior to the alleged occurrence some unknown persons had assembled in

Patna High Court Cr.Misc. No.12906 of 2016 (2) dt.31-03-2016 2/2 the house of the petitioner and except the aforesaid materials, there appears to be nothing against the petitioner, who is languishing in jail custody since long and the investigation against her has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 255 of 2015.
